Terms of Service
What you agree to when you buy from Web Assist: billing, renewals, canceling, refunds and fair use.
Last updated: October 20, 2026
These terms apply when you buy or use a service from Web Assist through webassist.co. By placing an order at checkout, accepting a proposal, or signing up for a plan, you agree to them. We’ve written them as plainly as we can. Please read section 2 in particular: it explains the limits on our liability.
1. About us
Web Assist (Pty) Ltd (“Web Assist”, “we”, “us”) is a company registered in South Africa, registration number 2016/081371/07.
- Address: 1 Seacrest, 18 Adelaide Road, Kingsburgh, 4126, South Africa
- Contact: webassist.co/contact
- Telephone: +27 78 016 0706
- Website: https://webassist.co
“You” means the person or business buying the service. If you sign up on behalf of a business, you confirm you’re allowed to bind it to these terms.
2. Important: our liability
Please read this section before you sign up.
- Websites and servers can go down or lose data for reasons we can’t fully control, such as hardware or network failures, attacks, software faults and outages at our providers. We take reasonable care to prevent this and to restore service quickly, but no online service can be available 100% of the time, and we can’t promise that data will never be lost.
- We’re not liable for indirect or consequential losses, such as lost profits, lost sales, lost business opportunities or damage to reputation.
- Our total liability to you for all claims in any 12-month period is limited to the fees you paid us for the affected service in that period.
- Nothing in these terms limits liability that can’t legally be limited, such as for death or personal injury caused by negligence, fraud, gross negligence or deliberate wrongdoing. Nothing in these terms takes away rights you have as a consumer under the law where you live.
- If you buy for a business, you also agree to cover (indemnify) us against certain claims from other people (section 17).
3. Our services
Through webassist.co we offer:
- Website as a Service (WaaS): we build, host and look after a website for you for a monthly or annual fee;
- WordPress hosting;
- website management, which includes hosting, updates, backups and unlimited content edits. Content edits are copy changes, new or updated images, and similar updates to existing pages, plus fixing bugs. New features, new page designs and redesigns are quoted separately;
- custom website design, development and marketing work (such as SEO), each under its own written proposal.
What each plan includes is shown on its pricing card when you buy, and forms part of these terms. If a proposal or order says something different from these terms, the proposal or order applies to that point.
We don’t sell domain names or email accounts. You can use any domain you own, and we’ll help you point it to your website and connect email from your own provider.
4. Your account and responsibilities
You agree to:
- give us accurate contact and billing details, and keep them up to date;
- keep your logins private, and tell us straight away if you think someone else has used them;
- only put content on your website that you own or are licensed to use, and that is lawful;
- follow the laws that apply to your website and business, including privacy, consumer and advertising law;
- give us the content, approvals and access we need, when we need them;
- keep your domain name registered and paid for with your registrar;
- keep your own copy of any content you can’t afford to lose (see section 11).
5. Prices, billing and renewal
- Prices are in US dollars. The price and billing period are shown at checkout, and you confirm them before you pay.
- Payment is taken through our checkout (SureCart) using PayPal.
- Plans renew automatically at the end of each billing period (monthly or annual) until you cancel. You can cancel at any time from your customer dashboard (section 7).
- Annual plans are paid a year in advance and cost 10% less than paying monthly. We email you 30 days before each annual renewal with the renewal date and price.
- If we change a plan’s price, we’ll email you at least 30 days before. The new price applies from your next renewal, and you can cancel before then.
- Work under a proposal is invoiced as set out in that proposal.
6. Late or failed payments
If a payment fails, we’ll let you know and try again. If it’s still unpaid 7 days after the due date, we may suspend the service. If it’s still unpaid 30 days after the due date, we may close the account and delete its data. We’ll always warn you by email before we close an account.
7. Canceling
- Monthly and annual plans have no fixed contract. Cancel from your customer dashboard or contact us. Your plan stays active until the end of the period you’ve paid for.
- Website as a Service plans need 30 days’ notice, so we can wind your website down properly or hand it over (section 10).
- We can end a service with 30 days’ notice by email, for example if we stop offering it. If you’ve paid in advance, we’ll refund the full months you haven’t used.
Your legal right to cancel (UK and EU consumers)
If you’re a consumer in the UK or EU, you have 14 days from your purchase to cancel an online purchase. Our 30-day money-back guarantee (section 8) already covers this period and gives you more.
8. Refunds
30-day money-back guarantee
If you’re not happy within 30 days of your first payment, on a monthly or an annual plan, tell us and we’ll refund that payment in full. No cancellation fees. We may ask what we could have done better, but you don’t have to answer.
Monthly plans
After the first 30 days, monthly payments aren’t refunded for part-months. When you cancel, your plan stays active until the end of the month you’ve paid for.
Annual plans
- In the first 30 days: a full refund, as above.
- After 30 days: you can still cancel at any time. We refund the full months you haven’t used. The months you’ve used are charged at the normal monthly price, because the 10% saving only applies to a full year. For example, you pay $2,127.60 for a year of a $197-a-month plan and cancel after 4 months: we charge 4 × $197 = $788 and refund $1,339.60.
- Renewals: if your annual plan renews and you didn’t mean it to, tell us within 14 days of the renewal and we’ll refund the renewal in full.
Not refundable
- Work done under a separate proposal or agreement (for example custom design, development or marketing projects). The refund terms are in that proposal.
- Third-party licenses or services bought specifically for you at your request.
- Accounts closed because of a breach of section 13 (acceptable use), except where the law says otherwise.
How refunds are paid
Ask for a refund from your customer dashboard or by contacting us. Refunds go back to the payment method you used (PayPal), usually within 5 to 10 business days.
9. Custom design and development projects
- Each project is based on a written proposal that sets out the scope, price, payment schedule and timeline. Work outside the proposal is quoted separately before we do it.
- The proposal says how many rounds of changes are included. Further changes are charged at our hourly rate.
- If we’re waiting on you for content, feedback or approval for more than 60 days, we may close the project and invoice the work done so far.
- The final payment is due before the website goes live or is handed over.
- Third-party costs, such as paid plugins, fonts, images or services, are your cost unless your proposal includes them.
10. Website as a Service (WaaS)
- There’s no deposit. Your plan starts when you sign up, and we build your website.
- The monthly content update time shown on your plan’s pricing card doesn’t carry over to the next month.
- Website as a Service is a subscription: we build and run the website for you, and the website stays ours while you subscribe. Your content (the text, images, logos and other material you give us) always stays yours.
- If you’d like to leave and take the website with you, you can buy it out for a one-time payment equal to 12 months of your plan’s monthly fee. We then hand over the website files and content. This doesn’t include third-party licenses (for example paid plugins); you’ll need your own.
- If you leave without buying the website, we’ll send you a copy of your content on request, and take the website down at the end of your notice period.
11. Hosting, fair use, backups and your data
- Every plan includes a monthly visit allowance, shown on its pricing card. A visit is one unique visitor in 24 hours; bots and crawlers don’t count. Occasional spikes are fine. If your site goes over its allowance two months in a row, or its traffic starts affecting other sites on the server, we’ll contact you and recommend upgrading your plan or moving to your own cloud server, priced separately. There are no overage charges, and we won’t take your site down without talking to you first, except in an attack or emergency that puts other clients at risk, where we may limit traffic temporarily.
- Website as a Service and website management: we back up your website on the schedule shown on its pricing card, and keep copies on the server for 14 to 30 days and in at least one other location for up to 90 days, depending on the plan.
- WordPress hosting: we back up your website on the schedule shown on its pricing card, and keep backups on the server for 30 days and in at least one other location for up to 90 days.
- Backups are a safety net, not a guarantee: keep your own copy of anything you can’t afford to lose.
- On request we’ll restore a backup. Restores needed because of changes you made yourself may be charged at our hourly rate.
- When a service ends, we keep the website’s data for 30 days and then delete it, unless the law requires us to keep it. Ask us before then if you’d like a copy.
12. Third-party services
Our services rely on other companies, such as hosting, payment, email-sending and software providers, and the plugins and themes your website uses. We choose them carefully and will help where we reasonably can, but we’re not responsible for their faults or for changes they make to their own products, prices or terms.
13. Acceptable use
You may only use our services for lawful purposes. You may not host, send or link to:
- material that infringes someone else’s copyright, trademarks or other rights;
- adult or sexually explicit content, or content that is threatening, abusive, defamatory or fraudulent;
- malware, hacking or cracking tools, phishing pages or pirated software;
- spam or other unsolicited bulk email.
You also may not use our services in a way that disrupts our servers or other clients’ websites.
If we find content that breaks these rules, we’ll contact you and may suspend the affected service until it’s resolved. In serious cases (for example malware or illegal content that puts others at risk) we may act first and tell you straight away afterwards.
14. Ownership and licenses
- Your content (text, images, logos, data) stays yours. You give us permission to use it to provide the services.
- A website we design and build for you under a proposal or a website management plan is yours once it’s paid for in full, except for our own reusable code, components and tools, and third-party software, plugins, themes, fonts and images, which are licensed rather than owned. Website as a Service websites are covered by section 10.
- Software licenses we provide as part of a plan can be used while you’re on that plan. If you leave, you’ll need your own.
- We may show your website in our portfolio unless you ask us not to.
15. Search, advertising and analytics
- We work to improve your search rankings and marketing results, but search engines and ad platforms set their own rules and change them often. We can’t guarantee rankings, traffic, leads or sales.
- Advertising spend is paid to the ad platform (for example Google or Meta), usually from your own account. It’s separate from our fee and isn’t refundable by us.
- You’re responsible for the claims made in your advertising and on your website.
16. Personal data
How we handle personal information about you is set out in our Privacy Policy.
When we host or manage your website, we handle personal data about your visitors and customers (for example form entries and orders) on your behalf. For that data you are the controller and we are your processor (UK GDPR), or you are the responsible party and we are your operator (South Africa’s POPIA). We will:
- process it only to provide the services and on your documented instructions, unless the law requires otherwise;
- make sure everyone who handles it for us is bound to keep it confidential;
- keep it secure, using appropriate technical and organizational measures;
- use other processors (such as hosting and backup providers) only under written terms that protect the data in the same way, and tell you before we add or replace one so you can object;
- help you respond to requests from people exercising their data rights, and with your own security and data protection duties;
- tell you without undue delay if we become aware of a breach affecting it;
- delete or return it when the service ends, as set out in section 11, unless the law requires us to keep it;
- give you the information you reasonably need to show that these duties are met.
Our team works from South Africa, and some of our providers are in the United States or elsewhere. Where the law requires a transfer safeguard (for example the UK International Data Transfer Addendum), we’ll put one in place with you.
You’re responsible for having a lawful basis to collect that data and for your own website’s privacy policy.
17. Liability and indemnity
- Section 2 sets out the main limits on our liability. They apply to every claim, whether in contract, negligence or otherwise.
- We provide our services with reasonable care and skill. Apart from that and the rights the law gives you, we don’t make any other promises about the services.
- If you’re buying for a business, you agree to cover us, our team and our contractors against claims, losses and reasonable legal costs brought by other people that arise from the content, products or services on your website or in your advertising, from your breach of these terms or the law, or from anyone using your logins.
18. Things outside our control
We’re not responsible for delays or failures caused by events outside our reasonable control, such as outages at upstream networks or providers, attacks, power failures, natural disasters or government action. We’ll tell you and restore the service as soon as we reasonably can.
19. Changes to these terms
We may update these terms. If a change affects you materially, we’ll email you at least 30 days before it takes effect and show the new date at the top of this page. If you don’t agree, you can cancel before the change takes effect.
20. Complaints, disputes and governing law
- If something goes wrong, contact us and we’ll do our best to put it right quickly.
- These terms are governed by the law of South Africa. If you’re a consumer, you keep the protections of the consumer law of the country or state where you live, and you can bring a claim in the courts there.
- If you’re a business, the courts of South Africa will decide any dispute we can’t settle between us.
21. General
- These terms, your order or proposal, and our Privacy Policy make up the whole agreement between us.
- If any part of these terms is found to be invalid, the rest still applies.
- If we don’t enforce a term straight away, we can still enforce it later.
- We may use contractors and service providers to deliver the services. We remain responsible for their work.
- We send notices to the email address on your account. You can send notices to us through our contact page.
